Terms & Conditions

Overview:

The following terms and conditions apply to all bookings with one of our training programs (“course”, “booking” and/or “program”) with Project Snow Limited (“Project Snow”, “Our”, “Us” or “We”). We may update our terms and conditions at any time by updating this website (with or without notifying you). 

Our programs are to gain ski/snowboard skills training and instruction certifications and do not include any type of job offer. 

Acceptance of terms:

By applying for a program or placing a non-refundable deposit, you are agreeing to all of our terms and conditions, as amended by us from time to time. We reserve the right to refuse any applicant for any reason, other than any prohibited grounds under the Human Rights Act 1993. 

Financial Responsibility:

Once we receive and process your deposit we will send you an invoice with your program name, payment plan, and remaining balance. 

  • Your initial $1000 USD deposit will be non-refundable unless we decide otherwise in our sole discretion.
  • Your second payment of $5000 USD must be received within 6 weeks unless we have agreed to an alternate payment plan in writing. 
  • Your final balance must be paid at least 4 weeks before your program start date unless otherwise agreed. 
  • There is a 2 week grace period for any missed payments and then your account will be in default. If your account is in default, we may cancel your place or charge default interest at a rate of 15% per annum on any outstanding amounts. If we cancel your place for default, any payments you’ve made will be forfeited.
  • When included, we will only cover the exam fee for the initial attempt. You will be responsible for any costs associated with subsequent attempts. 
  • Costs for anything outside of your program fee such as flights, travel insurance, gear, living costs, etc will be your responsibility to make directly to the relevant provider/s and you will be subject to their respective terms and conditions. 
  • Accommodation and rental gear program elements may require a damage deposit. Please identify and communicate any existing damage upon arrival in writing via info@projectsnow.com. This bond will be returned within two weeks after the program end date. 

Pricing:

We will do our best to ensure that our website and all communications represent current pricing and inclusions. We reserve the right to change any elements and/or pricing before you pay your deposit and pricing is subject to change before your final balance has been received. 

Fluctuations in exchange rates, fuel, taxes and provider fees may affect the total program fee. We will cover the first 3% of any increase. The remaining increase up to 15% will be covered by you. If the increases are over 15% you will be able to apply for cancellation and a refund (excluding the non-refundable $1000 USD deposit). 

All program fees and payments are in USD. Presentation of any other currency are strictly approximations based on current exchange rates and are for illustrative purposes only. 

If You Want to Cancel:

You can cancel your place on one of our programs at any time by emailing info@projectsnow.com. We provide no refunds if you cancel your place, unless we decide otherwise in our sole discretion. 

**3** We appreciate that life events can change your availability and in certain circumstances we will allow you to defer your booking to a future season. The following will apply:

  • Deferral requests before 5 months of the program start date will incur up to a $2000 USD deferral fee, and we will keep in credit any other payments you have made towards a future program you undertake.
  • **1** Deferral requests within 5 months of the program start date will be assessed on a case by case basis. If we are able to fill your spot then we will allow you to defer to a future season if you pay up to a $2000 deferral fee, otherwise you will forfeit all payments.

If We Need to Cancel: 

Our number one priority is for you to have an incredible experience with us and we will do everything in our power to provide all of the program elements during your selected season. We reserve the right to make changes if necessary and will notify you as soon as possible to work out a solution. 

Where we cancel, including due to situations that are outside of our control such as war, riots, pandemics, weather events, terrorism or civil unrest (or any other type of situation that we cannot control), Project Snow will not accept any type of liability or be required to offer any type of payments/compensation, to the extent permitted by law. In these situations we will however offer the following options: 

  • Where we have a viable option for the same season: We will move you to an alternative resort with similar program elements, which may be in a different country (as determined by us in our sole discretion). You will be responsible for any reasonable extra costs required where we offer a similar program for the same season, but if the extra costs would exceed USD$2,000, we may instead move you to the same program for the following season at no extra cost.
  • Where we do not have a viable option for the same season: We will move you to the same program for the following season at no extra cost. This is part of our Winter Stoke Guarantee. See **2**

If you breach any of these terms, or become insolvent or unable to pay your debts when they fall due, we may cancel your program and/or terminate these terms, and require you to immediately pay all amounts outstanding.

Our Liability:

Project Snow, our representatives and employees purely work as a booking agent. Travelling and skiing/snowboarding have inherit risks and we accept no liability whatsoever for any reason including but not limited to injury, accidents, loss, theft, damage, sickness or death that you may experience before, during or after your program with us (to the extent permitted by law). 

We accept no liability or any associated costs if you do not protect yourself with adequate travel insurance even in the case where we have made a referral or recommendation to a provider. You accept all responsibility for researching and confirming that you have adequate coverage for your program. 

To the extent permitted by law, we will not be liable for any indirect or consequential loss, or for any loss of profit, data or opportunity, and our liability for any other losses will be limited to the invoiced value of your program. 

Photos and videos are taken of participants during our courses.  You agree that we can (and grant us a non-exclusive, royalty-free licence to) use, modify, publish and distribute any photos and videos of you for advertising, promotional and business purposes. You waive any right to inspect or approve such photos and videos. Please let us know in writing if you do not wish to have photographs and videos of you used publicly, and we will discuss your options with you.

Project Snow will not be held responsible for any outside arrangements you may make before, during or after attending one of our programs. This includes but is not limited to travel arrangements, outside training, insurance, visas, or anything else part of or in conjunction with your program elements. This includes any instances where we made a recommendation or referral to a providing partner. 

Most citizenships can enter Japan on a tourist visa but we offer no guarantee and full responsibility for obtaining and managing your ability to enter the country will be yours. We will do our best to provide you with the most up to date information but this falls under an outside arrangement where you will have to ensure your ability to attend your program. If you are unable to enter and attend your program there will be no refunds and point **1** will apply for a potential deferral.  

You must pay all costs we incur (including legal costs, as between solicitor and client) in the enforcement of our rights or remedies under these terms.

Your contract with Project Snow Limited is subject to New Zealand law and the exclusive jurisdiction of New Zealand courts. In the unlikely event of a dispute, negotiation and mediation in New Zealand will be the primary option for resolution. 

Guarantees:

**2** Winter Stoke Guarantee:

Covid has changed travel moving forward and we want you to book with confidence. We can’t predict the next pandemic or global situation that may disrupt everything which is why we will guarantee your spot with no additional fees on top of your program fee for the following season if we are unable to provide the program for reasons beyond our control. If the program can run the following season and you would like to defer to a later date then this will fall under our deferral rules, see **3**

Performance Guarantee:
We know that your ski or snowboarding ability will be light years ahead of where you started the season. If after your last day of training you feel that you haven’t advanced to a level that you are happy with you will have additional group lesson days available to work on any skill set that you’d like. (2 days in total for 4 week programs, 5 days in total for 11 week programs). In order to qualify you must attend all training sessions during your program. We will assess on a case by case basis if you have only missed 1 or 2 days due to injury or sickness. 

We warrant that we will provide our services with reasonable skill and care and in accordance with any reasonable timeframes agreed with you. Except as set out in these terms, we expressly exclude any other warranties and guarantees that might otherwise be implied by law, trade, custom or otherwise.

Your Responsibilities:

All documentation

You are responsible for all pertinent documentation for your season including but not limited to valid passport with a qualifying time to expiry, travel documents, tourist visa, international drivers license, travel insurance, vaccination/health certificate. For all up to date requirements you should check the Japanese embassy website. Any costs associated with being unable to travel due to missing or incorrect documentation will be your responsibility. 

Travel insurance

You agree to purchase personal travel insurance with adequate winter sports cover, trip cancellation coverage (when available) and personal liability (when available) prior to the start of your course. Project Snow recommends that you purchase personal travel insurance as soon as you submit your deposit and your placement has been confirmed.

Physical level

You must be in good physical and mental health to attend one of our training programs. We recommend training before the season begins. You must notify us of any medical conditions with confirmation from your doctor that you are at a level of fitness to safely attend one of our programs. 

Conduct

You will conduct yourself with propriety with no disruption to the experience of the other trainees. You will act with professionalism with any program representatives, snow trainers, and any other providers. Any behaviour that is deemed unacceptable or is harmful to anyone on or associated with the program or Project Snow’s reputation may mean that you will be removed from the course. If so, you will not be entitled to any refund and Project Snow reserves the right to recover any costs or damages incurred. 

Training Ski School Code of Conduct

Our snowsports training partner can impose their own code of conduct. They reserve the right to remove any course participants who repeatedly breach behavioural and presentation standards. No refunds will be payable for any unused components of the package.

Damage deposit

You will be required to provide a refundable damage deposit towards your accommodation and gear. It is your responsibility to conduct a thorough inspection at the beginning of your program and report any existing damage immediately to info@projectsnow.com. Failure to do so will result in your liability of any costs associated with repair or replacement. 

Security and safety

You are responsible for seeking your own advice regarding security and safety. You should review your embassy’s information for travel overseas and to Japan.

Special requirements

If you have any specific requests, medical or dietary needs you need to inform us at the time of confirming your placement. We will do everything possible to work with your situation but provide no guarantee. 

Complaints

We endeavour to provide you with the most amazing experience possible in Japan. In the unlikely event that a problem arises please contact your local representative or email us at info@projectsnow.com immediately and we will work diligently towards resolution. For any further complaints, you must contact us within 30 days of the program finish date and we will respond within 14 days to work towards an amicable solution. 

Terms and Conditions Acceptance:


By applying and paying the initial deposit, you confirm that:

  • You have read and agreed to these Terms and Conditions
  • You will act responsibly and in accordance with these Terms and Conditions at all times
  • You have provided true, complete and accurate information to us
  • You understand our terms relating to cancellations and refunds 
  • You will make all payments when due
  • You are over 18 years of age, or are the parent or legal guardian of the applicant who is under 18 years of age (in which case both minor and parent/guardian must accept these terms, and the parent/guardian must pay the deposit)
